DMCA Policy

We respect intellectual property rights and respond promptly to valid copyright infringement notices.

Important: This DMCA Policy applies to content hosted on socialgradeup.in. SocialGradeUp is based in India and is committed to respecting copyright and intellectual property laws, including the principles of the Digital Millennium Copyright Act (DMCA) and applicable Indian copyright law under the Copyright Act, 1957.

1. Overview

SocialGradeUp ("we", "us", "our") takes copyright infringement seriously. If you believe that content published on our website infringes your copyright, you may submit a formal takedown notice using the process described below. We will review all valid notices and take appropriate action, which may include removing or disabling access to the allegedly infringing content.

2. What Constitutes Copyright Infringement

Copyright infringement occurs when a protected work — such as text, images, graphics, videos, audio, or other creative content — is used without the permission of the copyright owner. This includes reproducing, distributing, publicly displaying, or creating derivative works without authorisation.

Before submitting a notice, please consider whether the use may qualify as fair dealing under Indian law (e.g., for criticism, review, education, or news reporting) or falls within another exception to copyright protection.

3. How to Submit a DMCA Takedown Notice

To report copyright infringement, send a written notice to us at socialgradeup@gmail.com with the subject line "DMCA Takedown Notice". Your notice must include all of the following:

  • Your full name and contact information — including your email address and phone number
  • Identification of the copyrighted work — a description or link to the original work you claim has been infringed
  • Identification of the infringing material — the specific URL(s) on our website where the allegedly infringing content appears
  • A statement of good faith — that you believe in good faith the use of the material is not authorised by the copyright owner, its agent, or applicable law
  • A statement of accuracy — that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on their behalf
  • Your electronic or physical signature

Incomplete notices may not be acted upon. We reserve the right to request additional information to verify the validity of a claim.

4. Our Response Process

Upon receipt of a valid DMCA notice, we will:

  • Review the notice to confirm it meets the requirements above
  • Acknowledge receipt of your notice within 5 business days
  • Remove or disable access to the allegedly infringing content if the notice is valid
  • Notify the party who posted the content (if applicable) that it has been removed

We aim to process all valid notices within 10 business days of receipt.

5. Counter-Notice Process

If you believe your content was removed in error, you may submit a counter-notice to socialgradeup@gmail.com with the subject line "DMCA Counter-Notice". Your counter-notice must include:

  • Your full name and contact information
  • Identification of the content that was removed and the URL where it appeared
  • A statement under penalty of perjury that you believe the content was removed as a result of a mistake or misidentification
  • Your consent to the jurisdiction of the courts of Dharwad, Karnataka, India
  • Your electronic or physical signature

If we receive a valid counter-notice, we may restore the removed content within 10–14 business days unless the original complainant notifies us that they have filed legal action.

6. Repeat Infringers

SocialGradeUp has a policy of terminating the accounts and access of users or contributors who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders, in appropriate circumstances and at our sole discretion.

7. Misuse of DMCA Notices

Submitting a false or misleading DMCA takedown notice may expose you to legal liability, including damages and legal fees. If you are not certain whether content infringes your copyright, we recommend consulting a qualified intellectual property lawyer before submitting a notice.

8. Changes to This Policy

We may update this DMCA Policy from time to time. When we do, we will update the effective date at the top of this page. We encourage you to review this policy periodically.
